  • You can enquire via the contact form at https://danobriencreative.com/enquiries. Once your session details are confirmed, a booking fee is required to secure your shoot date.

  • Yes. You must be 18 years of age or older to book a session and to be a subject of the shoot. By confirming your booking, you are confirming that you meet this requirement. Proof of age may be requested prior to the session.

  • If you are booking on behalf of another adult, that person must also be 18 or older if they are the subject of the shoot. Sessions involving minors as the primary subject require a separate written agreement, written parental or guardian consent, and a parent or guardian present throughout the session. Please get in touch to discuss your specific needs before booking.

  • Popular dates book up quickly, particularly on weekends. We recommend enquiring at least 2–4 weeks in advance for portrait sessions, and 4–8 weeks for commercial shoots. For time-sensitive bookings, contact us directly to check availability.

  • Please contact us as soon as possible. The booking fee is non-refundable. If you need to cancel with less than 48 hours notice, the booking fee is forfeited. If you need to reschedule and give more than 48 hours notice, we will do our best to find a suitable alternative date, subject to availability. If the Photographer needs to cancel for any reason, you will receive a full refund or the option to reschedule.

  • You will receive a pre-shoot brief once your booking is confirmed. This will cover wardrobe suggestions, location details, timing, and anything specific to your session type. Feel free to reach out with any questions ahead of your shoot day.

  • Yes you’re more than welcome to bring someone for support/assistance. Please advise if there will be an extra persons arriving during the bookings. However they are to operate in a support role and not part of the shoot or direction.

  • No. Copyright in all images remains with Dan O’Brien Creative at all times. What you receive is a licence, the right to use the images within the terms agreed. Ownership of the copyright itself is never transferred, regardless of payment.

  • A licence is permission to use the images in specific ways. Your standard licence covers personal use, personal social media, promoting your own business or brand, editorial coverage about you, and internal business use. It does not permit selling the images, using them in campaigns for third-party brands, or submitting them to stock libraries.

  • Yes. Using your images to promote your own business, on your website, Instagram, LinkedIn, press materials, and similar, is included in the standard licence. This applies to your own brand only, not to advertising or promotions for other companies or products.

  • No. Selling, sublicensing, or using images in a way that generates direct revenue from the images themselves, such as selling prints, licensing to third parties, or submitting to stock platforms is not permitted under the standard licence. If you require this type of use, please enquire about an extended commercial licence.

  • Dan O’Brien Creative retains the right to use images for portfolio, website, and promotional purposes. If you require full confidentiality (for example for unreleased product launches or sensitive personal matters) please discuss this before your session so a confidentiality agreement can be arranged.

  • It is not always mandatory, but it is greatly appreciated. A simple credit such as “Photo: Dan O’Brien Creative” or tagging @danobriencreative on social media goes a long way in supporting independent photographers. For commercial usage, crediting may be a condition of the licence.

  • Edited images are typically delivered within 1–3 weeks of your review session, depending on the type of shoot and current booking volume. Your expected turnaround time will be confirmed at booking. Rush delivery may be available for an additional fee.

  • Your images will be delivered via a private online download link. Files are available for a limited period, so please ensure you download and back up your images promptly. Dan O’Brien Creative is not responsible for redelivery after the link expires.

  • The number of delivered images depends on your session type and package. This will be confirmed in your booking details and review session. If you have questions about what is included in your specific package, please ask before your session.

  • Minor retouching is included as part of the standard editing process. If you have specific retouching requests beyond the standard scope (such as significant skin retouching, background removal, or composite work) these may incur an additional fee. Please discuss your expectations before the session to avoid any surprises.

  • Minor personal adjustments for personal use are fine. However, applying heavy filters or significant post-processing to images that are then used publicly (particularly for business or promotional purposes) is not permitted if it materially alters the original work. If in doubt, please ask before posting.

  • Advertising campaigns, particularly those promoting third-party brands or products, are not covered by the standard licence. An extended commercial licence is required. Please get in touch before your shoot to discuss the scope of use, distribution, and the appropriate fee.

  • Product packaging, brand campaigns, and any usage where the images are directly tied to commercial output beyond promoting your own business require an extended licence. Fees are based on the nature of the use, the scale of distribution, and any exclusivity requirements. Contact us to discuss your project.

  • No. Submitting images to stock libraries, including Getty, Shutterstock, Adobe Stock, or similar platforms, is expressly prohibited under the standard licence. This includes free stock platforms. If you have a specific reason for needing stock distribution rights, please discuss this before the shoot.

  • Accepted payment methods will be confirmed at the time of booking. Payment details are provided with your booking confirmation. The remaining session balance is due prior to or on the day of your shoot unless otherwise agreed in writing.

  • Dan O’Brien Creative takes every precaution to ensure a smooth session. In the rare event of equipment failure or circumstances outside the Photographer’s control that impact the shoot, liability is limited to a refund of fees paid. No compensation for indirect losses will be accepted. For high-value commercial shoots, we recommend arranging your own content insurance.

  • Yes. These terms are governed by the laws of the State of Victoria, Australia. Any disputes are subject to the jurisdiction of the Victorian courts. The terms are also written in compliance with the Copyright Act 1968 (Cth), which governs ownership of photographic works in Australia.
